If you disagree with any part of these Terms, you may not access or use our Service. Your continued use of the Service constitutes acceptance of any modifications to these Terms.

2Eligibility and Account Requirements

To use the Service, you must:

• Be at least 13 years old (or the minimum age required in your jurisdiction)
• Have a valid Discord account in good standing
• Comply with Discord's Terms of Service and Community Guidelines
• Have the legal capacity to enter into a binding agreement
• Not be banned or suspended from our Service

Server administrators must have "Manage Server" permissions to configure bot features and settings.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are prohibited from:

• Using the Service for any illegal, harmful, or fraudulent activities
• Attempting to disrupt, damage, or interfere with the Service
• Bypassing security measures or accessing unauthorized areas
• Impersonating other users or entities
• Violating intellectual property rights
• Spamming, harassing, or abusing other users
• Distributing malware, viruses, or harmful content
• Using the Service to collect personal information without consent
• Attempting to reverse engineer or exploit the Service
• Violating Discord's Terms of Service or Community Guidelines

5Premium Services and Subscriptions

We offer premium features and subscriptions that provide enhanced functionality:

• Subscription Management: Premium subscriptions are managed through our platform with various tier levels and service types
• Promotional Codes: We may offer promotional codes for free access to premium features for limited periods
• Payment Processing: Billing is handled by secure third-party processors like Paddle
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Refunds: Refund policies are subject to our payment processor's terms and applicable laws

Premium features are tied to specific servers and user accounts. Subscriptions are non-transferable between servers or accounts.

6User Content and Data

You retain ownership of content you submit through the Service, but grant us necessary rights to provide our services:

• We may store and process your Discord account information for authentication
• Server configuration data is stored to maintain your bot settings
• Support ticket content may be retained for customer service purposes
• Usage analytics help us improve our services

7Account Termination and Bans

We aim to respond to support requests within 48 hours. Premium users may receive priority support for technical issues.

• Collection of Discord account information through OAuth
• Storage of server configuration and usage data
• Processing of payment information by third-party processors
• Analytics collection for service improvement

10Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Pro-tonn and are protected by intellectual property laws. You may not:

• Reverse engineer or attempt to extract source code
• Create derivative works based on our Service

11Third-Party Services and Integrations

Our Service integrates with and relies on third-party platforms:

• Payment Processors: Paddle and other secure billing services
• Analytics Tools: Performance monitoring and usage analytics

We are not responsible for the availability, content, or practices of these third-party services.

12Disclaimer of Warranties

The Service is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, error-free operation
• Warranties regarding security or data protection
• Guarantees of compatibility with all Discord servers

Use of the Service is at your own risk. We do not guarantee that the Service will meet your requirements or be available at all times.

13Limitation of Liability

To the maximum extent permitted by law, Pro-tonn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Server downtime or service interruptions
• Damages resulting from third-party actions
• Issues arising from Discord platform changes

Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.

14Indemnification

You agree to indemnify and hold Pro-tonn harmless from and against any claims, damages, liabilities, costs, or expenses arising out of:

• Your violation of these Terms or applicable laws
• Content you submit or actions you take using the Service
• Your infringement of any third-party rights
• Your use or misuse of the Service

15Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, technology, or legal requirements. When we make changes, we will:

• Post the updated Terms on our website
• Update the "Effective Date" at the top of this document
• Announce changes through our Discord server or bot commands
• Provide at least 7 days notice for material changes

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of laws principles. Any disputes shall be resolved through:

• Good faith negotiations between the parties
• Binding arbitration if negotiations fail
• Exclusive jurisdiction in California courts for any remaining disputes
